Carina du Toit says organisation is not working in co-operation with DA MP on mud schools case.
We note with concern the statements made by Dr Wilmot James MP and erroneous newspaper articles regarding the matter between the Centre for Child Law and the Minister for Basic Education in respect of the upgrading of the infrastructure of mud-schools in the Eastern Cape and the implementation of the memorandum of agreement.
We are closely monitoring the Department of Education's implementation of this order and together with our attorneys, the Legal Resources Centre have appointed a consultant to work with the Department of Education and monitor the implementation of the agreement. We consider that constructive engagement with the Department of Education in this regard is essential.
The Centre is obviously concerned that the implementation of the agreement should happen as quickly and effectively as possible. To the extent necessary, the Centre reserves its right to approach a court in this regard. However, at this stage, the Centre does not see any need to approach a court for relief.
In particular we are not working in co-operation with Dr Wilmot James MP to return to the Bisho High Court to compel government to take action as was erroneously stated in newspaper reports. The Centre will ensure that it acts in the best interests of the learners concerned and will not be coerced through pressure by political parties on anyone else not involved in the litigation to refer this matter back to court.
The Centre for Child Law, the crisis committees of the mud-structure schools and our attorneys, the Legal Resources Centre, will continue to monitor the implementation of the settlement and will take appropriate action when and if it should become necessary.
